Your acceptance of these Terms is indicated by any one or more of the following actions:

  • Submitting an enquiry form, callback request, or consultation request on our website.
  • Contacting us via WhatsApp, phone, or email to enquire about or engage a service.
  • Sharing any document, information, or credential with us for the purpose of a service.
  • Making a payment for any service we offer.
  • Clicking any "I Agree," "Submit," or similar button on any form we present.

You confirm that you are at least 18 years of age, have the legal capacity to enter into binding agreements, and — if engaging on behalf of a business — have the authority to bind that business to these Terms.

Eligibility

Our services are available to:

  • Individual taxpayers and salaried employees resident in India.
  • Non-Resident Indians (NRIs) and Overseas Citizens of India (OCIs) with Indian tax obligations.
  • Sole proprietorships, partnerships, LLPs, and private limited companies incorporated in India.
  • Startups and entrepreneurs seeking business registration or compliance services.
  • Any individual or entity with a lawful purpose and the legal capacity to enter into service agreements.

We do not knowingly provide services to individuals below 18 years of age without the verified consent of a parent or legal guardian. Engagement for minor-related filings (e.g., clubbed income of a minor child) must be initiated by the parent or guardian.

Engagement & Payment Terms

The following terms govern how services are engaged and paid for:

  • Service Quote: Before commencing any paid service, we provide a clear written quote via WhatsApp, email, or our website. The engagement begins only when you confirm acceptance of the quote.
  • Advance Payment: Some services may require full or partial advance payment before work begins. This will be communicated clearly in the quote.
  • Payment Methods: We accept UPI (PhonePe, GPay, Paytm), bank transfer (NEFT/RTGS/IMPS), and online payment via our website gateway. All amounts are in Indian Rupees (₹) unless otherwise specified.
  • Invoice: A GST-compliant invoice will be issued for all paid engagements, either before or immediately after payment, as agreed.
  • Taxes on Services: All service fees quoted are exclusive of applicable GST (18%) unless explicitly stated as GST-inclusive. GST will be charged additionally as applicable under law.
  • Payment Timing: We will not file any return, submit any application, or deliver any document on your behalf until all agreed payments are received, except where a prior written arrangement exists.
  • Payment Security: We do not store your card or UPI credentials. All online payments are processed through third-party PCI-DSS compliant payment gateways.

No Hidden Charges: The amount quoted is the amount you pay. We will not add charges for AIS cross-verification, regime comparison, acknowledgement delivery, or any other standard step included in the quoted service, without your prior agreement.

Client Responsibilities

To enable us to deliver our services accurately and on time, you agree to the following responsibilities:

  • Accurate Information: You will provide complete, accurate, and truthful information and documents required for the service. Any inaccuracy in information you provide that results in an incorrect filing, penalty, or notice shall be your responsibility, not ours.
  • Timely Document Submission: You will share all required documents (Form 16, bank statements, invoices, etc.) within the timeframe communicated by our team. Delays caused by late document submission may cause missed statutory deadlines — in such cases, late filing fees or penalties imposed by government authorities are your responsibility.
  • Review Before Approval: We will share a pre-filing computation or draft document for your review. You must review it carefully before giving approval. Once you approve and we file or submit, you cannot claim that the content was incorrect if the information was drawn from documents and data you provided.
  • Credential Safety: You must not share your Income Tax portal password, GST portal password, or other government credentials with us. We can operate most services through OTP-based authorisation alone. If you choose to share credentials, you do so at your own risk.
  • Responsive Communication: You will respond to requests for additional information, OTPs, clarifications, or approvals in a timely manner. Statutory deadlines cannot be extended on account of delays in client response.
  • No Misrepresentation: You will not intentionally provide false, forged, or misleading documents or information. Doing so constitutes a breach of these Terms and may constitute an offence under the Income Tax Act, GST Act, or other applicable laws — for which you alone bear full legal responsibility.
  • Applicable Laws: You are responsible for ensuring that the transactions and income you disclose to us are legal and compliant. We are not responsible for the legality of the underlying transactions — only for correctly reporting what you disclose.

Our Responsibilities

We commit to the following standards in delivering our services:

  • Professional Standard: All services will be delivered by qualified professionals — Chartered Accountants, Company Secretaries, and trained compliance specialists — in accordance with their respective professional standards.
  • Accuracy: We will use the information and documents you provide to prepare filings and documents to the best of our professional ability, applying current law as applicable at the time of filing.
  • Timely Delivery: We will complete services within the timeframe communicated to you, subject to receipt of all required documents and information from your side.
  • Pre-Filing Review: We will share a computation, summary, or draft with you for approval before any government filing is made on your behalf.
  • Confidentiality: We will maintain strict confidentiality of all information you share with us, in accordance with our Privacy Policy and ICAI professional ethics obligations.
  • Error Correction: If an error in your filing is attributable to our professional mistake (not to incorrect information you provided), we will correct it at no additional cost to you.
  • Transparent Communication: We will keep you informed of the status of your service, any complications or risks we identify, and any actions required from your side.

Professional Limitations & Nature of Advice

The following important limitations apply to the professional services we provide:

  • Tax & Legal Advice: Any advice, computation, or guidance provided by us is based on the information you share and the law as it stands at the time. Tax law changes frequently — we are responsible for applying the law current at the time of filing, not for anticipating future changes.
  • No Guarantee of Outcome: We do not guarantee any specific tax refund amount, assessment outcome, GST input credit claim approval, trademark registration, or court/tribunal outcome. We apply professional skill to maximise your position — outcomes depend on statutory authorities beyond our control.
  • Government Portal Downtime: Statutory filing portals (Income Tax, GST, MCA) are operated by the Government of India. We are not responsible for technical failures, downtime, or delays on these portals that affect filing timelines.
  • Litigation: Our services extend to preparation and filing of returns, registrations, and documents. Representation before tax authorities, appellate tribunals, or courts requires a separate engagement and is subject to separate fees and terms.
  • Changing Law: If the law changes after we provide advice but before you implement it, the advice may no longer be fully applicable. It is your responsibility to seek updated advice before acting on any guidance given previously.

Prohibited Use of Our Website & Services

You agree that you will not use our website or services for any of the following purposes:

  • Filing false, fraudulent, or fabricated income tax returns, GST returns, or any other statutory document.
  • Misrepresenting your identity, income, business nature, or any other material fact for the purpose of obtaining a service, tax benefit, government recognition, or registration.
  • Using our platform or team as a conduit for money laundering, tax evasion, benami transactions, or any other activity prohibited under Indian law.
  • Attempting to hack, scrape, reverse-engineer, or disrupt our website, systems, or client portal.
  • Sending unsolicited commercial messages (spam) through our contact forms or communication channels.
  • Impersonating another person, business, or government authority in any communication with us.
  • Attempting to obtain services beyond those you have legitimately paid for or engaged.
  • Using our website content, guides, or tools for any commercial purpose without our written permission.

Violation of any of the above may result in immediate termination of your engagement with us, reporting to relevant authorities where legally required, and pursuit of applicable legal remedies.

Limitation of Liability

To the maximum extent permitted by applicable law, Khajanchi Brothers Private Limited's total liability to you for any claim arising from or related to our services shall be limited to the fees actually paid by you for the specific service that gave rise to the claim.

We shall not be liable for any of the following, whether arising in contract, tort, negligence, or otherwise:

  • Any penalty, interest, or demand raised by the Income Tax Department, GST Department, or any other statutory authority on account of information you provided that was incorrect, incomplete, or misleading.
  • Any loss or damage arising from government portal downtime, technical failures, or delays in processing by statutory authorities.
  • Any indirect, consequential, or incidental loss — including loss of business, loss of income, or reputational damage — arising from your use of our website or services.
  • Any decision you make based on general information published on our website, without specific professional advice from our team.
  • Any unauthorised access to your data by a third party resulting from your own disclosure of credentials or passwords.
  • Any change in law after we deliver advice that renders that advice less favourable or inapplicable.

Note: Nothing in these Terms limits liability that cannot be lawfully excluded — such as liability for fraud, wilful misconduct, or death or personal injury caused by our negligence.

Confidentiality

Both parties acknowledge the confidential nature of information exchanged during the course of our engagement.

  • Our Obligation: We will not disclose any confidential client information to any third party without your express written consent, except as required by law or as described in our Privacy Policy.
  • Your Obligation: You will not disclose, publish, or share any proprietary methodologies, pricing structures, templates, or communications from our team to any third party for commercial purposes.
  • ICAI Professional Ethics: Our Chartered Accountants are bound by the ICAI Code of Ethics, which imposes a strict duty of professional confidentiality. This obligation survives the termination of our engagement with you.
  • Legal Disclosure: We may be required by law, court order, or regulatory authority to disclose certain information. Where legally permitted, we will notify you before doing so.

Refund Policy

We aim to deliver every service to the highest standard. Our refund policy is as follows:

  • Before Work Begins: If you cancel an engagement before we have commenced any substantive work on your matter, you are entitled to a full refund of any advance payment, less any government fees or third-party charges already incurred on your behalf.
  • After Work Has Commenced: If you cancel after we have begun work — including document review, data entry, regime comparison, computation, or draft preparation — the fee may be partially retained, proportionate to the work completed. The exact amount will be communicated transparently.
  • After Filing or Submission: Fees for services already delivered (ITR filed, GST return submitted, company incorporated, trademark application filed) are non-refundable. Government filing fees are non-refundable under any circumstances.
  • Our Error: If a filing error is demonstrably attributable to a professional mistake on our part — not based on incorrect information from you — we will correct the error at no cost. If a refund is appropriate in such circumstances, we will discuss it with you in good faith.
  • Refund Process: Approved refunds will be processed to the original payment source within 7–14 working days. To request a refund, write to info@khajanchibrothers.com with your engagement details.

Termination of Engagement

By you: You may terminate your engagement with us at any time by providing written notice via email or WhatsApp. Termination does not affect any obligations already performed or fees due for work completed.

By us: We reserve the right to decline or terminate any engagement, with or without cause, including in the following situations:

  • Discovery that you have provided false, fabricated, or misleading information.
  • Reasonable suspicion that the services are being used for illegal purposes — including tax evasion, money laundering, or fraud.
  • Failure to provide required documents or information within a reasonable timeframe, resulting in inability to meet statutory deadlines.
  • Abusive, threatening, or disrespectful behaviour toward our team members.
  • Non-payment of agreed fees after reasonable notice.

In the event of termination by us for cause, we reserve the right to retain fees for work already completed. We will provide all documents and filings made on your behalf up to the date of termination.

💡

Post-Termination: Our obligation of professional confidentiality continues indefinitely after termination of any engagement. We retain client records for the statutory periods described in our Privacy Policy.

Governing Law & Dispute Resolution

These Terms of Use and any dispute arising from your engagement with Khajanchi Brothers Private Limited shall be governed by and construed in accordance with the laws of the Republic of India.

  • Jurisdiction: The courts at Jhansi, Uttar Pradesh shall have exclusive jurisdiction over any dispute arising from or related to these Terms or our services, unless both parties mutually agree to an alternative.
  • Dispute Resolution — First Step: Before initiating legal proceedings, both parties agree to attempt to resolve any dispute through direct communication in good faith. Most disputes are resolvable through a conversation — we are committed to that.
  • Arbitration: If direct resolution is not possible, disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996, with a single arbitrator appointed by mutual agreement. The arbitration proceedings shall be conducted in English or Hindi in Jhansi.
  • Consumer Forum: Nothing in these Terms prevents you from approaching the appropriate Consumer Disputes Redressal Forum if you are a consumer as defined under the Consumer Protection Act, 2019.

Changes to These Terms

We may update these Terms of Use from time to time to reflect changes in our services, applicable law, or our operating practices. Material changes will be communicated to active clients via email or WhatsApp before they take effect.

The "Last Updated" date at the top of this page will always reflect the most recent revision. Your continued use of our website or services after the effective date of any update constitutes your acceptance of the revised Terms.

If you disagree with any material change, you may terminate your engagement with us as described in Section 15. You may also request a copy of the previous version of our Terms by writing to us.
